U.S. District Court Opinion on Royal Dutch Petroleum/Shell's Motion to Dismiss PDF Print E-mail

Decision by Judge Wood denying Defendants’ motions to dismiss. Specifically, the Court found that Plaintiffs have adequately pled violations of the law of nations for extrajudicial killing; torture; cruel, inhuman, or degrading treatment; violations of the right to peaceful assembly; violations of the right to life, liberty, and security of person, and crimes against humanity. The Court also found that Plaintiffs had adequately alleged that Shell and Anderson had acted under color of law, that Plaintiffs claims were not time-barred, and that Plaintiffs’ RICO claims could go forward.
